These Terms & Conditions ('Terms') govern your access to and use of the Maizou Pianist website and online piano course (the 'Service'), operated from Lyon, France. By creating an account, accessing our content, or purchasing the course, you agree to be bound by these Terms in full. If you do not agree, you must not use the Service.
1. Acceptance of these Terms
By registering an account or purchasing the course, you confirm that you have read, understood and accepted these Terms, as well as our Privacy Policy, and that you have the legal capacity to do so.
2. Description of the Service
Maizou Pianist provides pre-recorded online video lessons and related materials teaching Eastern-style piano. The Service is offered on a one-time-payment basis granting access to the lessons available at the time of purchase, as well as future updates to that same course, for as long as the Service remains available (see Section 7).
Course content, pricing, features and availability may change at any time. We reserve the right to add, modify, or discontinue any part of the content at our sole discretion, provided that access already granted for the core course content already purchased is not unreasonably reduced.
3. Eligibility and account registration
The Service is intended for users who are at least 16 years old. Users between 16 and the legal age of majority in their country of residence may only register and purchase with the consent and involvement of a parent or legal guardian, who accepts these Terms on the minor's behalf and remains responsible for the account and any purchases made.
You must provide accurate, current and complete information when registering — including your name, email address, phone number and country — and keep it up to date. You are solely responsible for maintaining the confidentiality of your password and for all activity occurring under your account. You must notify us immediately at hello@maizoupianist.com of any unauthorized use of your account.
We reserve the right to refuse registration, or to suspend or terminate any account, at our sole discretion, in particular in the event of a breach of these Terms, fraud, or misuse of the Service.
4. Pricing and payment
All prices are displayed on the Site in the currency indicated (typically US dollars) and are payable in full, in a single payment, via our payment processor, Stripe, at the time of purchase. We do not store your full card details.
Prices, discounts and promotional offers displayed on the Site may change at any time without notice; such changes will not affect a purchase already completed.
You are responsible for any taxes, duties, or bank/currency-conversion fees applicable to your purchase.
Any promotional code is subject to the specific conditions attached to it (validity period, eligible offers, non-cumulative with other offers) and may be modified, limited, or withdrawn at any time at our discretion.
5. Right of withdrawal — digital content
In accordance with applicable consumer-protection law on digital content supplied other than on a tangible medium (in particular Article L221-28 of the French Consumer Code, implementing Article 16(m) of EU Directive 2011/83/EU), by purchasing the course you expressly request immediate access to the digital content before the end of the standard 14-day withdrawal period, and you expressly and knowingly waive your right of withdrawal once access to the content has begun.
This waiver does not affect any statutory guarantee of conformity that may apply to digital content under applicable law, nor any right you may have if the content is materially defective or not as described.
Outside of any legal requirement, refunds are granted only at our sole discretion and are not owed as of right once access has been granted.
6. Access to content, license, and intellectual property
All videos, text, images, exercises, and other materials made available as part of the course ('Content') are and remain the exclusive property of Maizou Pianist or its licensors, and are protected by copyright and other intellectual-property laws.
Upon successful payment, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to access and view the Content for your own private, non-commercial, educational use, on any device you own or control.
You may not, and may not permit any third party to:
- Reproduce, copy, or download the Content other than through the Service's normal streaming functionality
- Redistribute, resell, sublicense, publicly display, or broadcast the Content
- Share your account credentials, or otherwise make the Content available to any person who has not purchased it
- Use the Content for any commercial purpose
- Circumvent, disable, or otherwise interfere with any technical protection measure
Any breach of this Section entitles us to immediately suspend or terminate the relevant account, without refund, and without prejudice to any other remedy available to us, including claims for damages.
7. Availability and modification of the Service
We make reasonable efforts to keep the Service available at all times, but do not guarantee uninterrupted, error-free, or fully secure access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our reasonable control.
We reserve the right to modify, suspend or discontinue the Service, in whole or in part, at any time, including for business, technical, or legal reasons. Where practically possible, we will give reasonable notice before permanently discontinuing the Service to purchasers with active access.
8. No guarantee of results; disclaimer
The Service is an educational tool. We do not guarantee any particular learning outcome, skill level, or result, as this depends on factors outside our control, including the user's individual practice, aptitude, and consistency.
The Service is provided 'as is' and 'as available', without warranties of any kind, express or implied, to the maximum extent permitted by applicable law.
9. Limitation of liability
To the fullest extent permitted by applicable law, Maizou Pianist shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of, or inability to use, the Service.
To the extent permitted by law, our total aggregate liability toward you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you actually paid for the course.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where applicable, liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence.
10. Termination
We may suspend or terminate your access to the Service, without prior notice and without refund, if we reasonably believe that you have breached these Terms, engaged in fraud (including payment fraud or chargeback abuse), or misused the Service.
You may stop using the Service and request deletion of your account at any time by contacting hello@maizoupianist.com; this does not entitle you to a refund of amounts already paid, except as required by law.
Sections of these Terms which by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — shall survive.
11. Governing law and jurisdiction
These Terms are governed by French law, without regard to its conflict-of-law principles.
Subject to any mandatory consumer-protection rules applicable in your country of residence, any dispute arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Lyon, France.
12. Changes to these Terms
We may update these Terms at any time. The updated version will be posted on this page with a revised 'last updated' date and will apply from the moment it is published. Continued use of the Service after any update constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
13. Miscellaneous
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be deemed replaced by a valid provision that most closely reflects its original intent
- Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and Maizou Pianist regarding the Service, and supersede any prior agreements
- We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control (force majeure), including but not limited to internet or hosting-provider outages, natural disasters, or acts of government
